{"id":25646,"date":"2021-04-16T13:50:27","date_gmt":"2021-04-16T11:50:27","guid":{"rendered":"https:\/\/php8.plastv.de\/?p=25646"},"modified":"2021-04-15T14:30:35","modified_gmt":"2021-04-15T12:30:35","slug":"25646","status":"publish","type":"post","link":"https:\/\/plas.tv\/?p=25646","title":{"rendered":"PACCOR brought an action for annulment against the new EU marking specifications for single-use beverage cups"},"content":{"rendered":"<p><span dir=\"ltr\">On<\/span><span dir=\"ltr\"> 11 <\/span><span dir=\"ltr\">March<\/span><span dir=\"ltr\"> 2021,<\/span><span dir=\"ltr\"> PACCOR,<\/span><span dir=\"ltr\"> a leading<\/span><span dir=\"ltr\"> global<\/span><span dir=\"ltr\"> player<\/span><span dir=\"ltr\"> in the<\/span><span dir=\"ltr\"> packaging<\/span><span dir=\"ltr\"> industry,<\/span><span dir=\"ltr\"> and<\/span><span dir=\"ltr\"> six<\/span><span dir=\"ltr\"> other<\/span><span dir=\"ltr\"> plastic<\/span><span dir=\"ltr\"> packaging <\/span><span dir=\"ltr\">manufacturers,<\/span><span dir=\"ltr\"> united<\/span><span dir=\"ltr\"> via<\/span><span dir=\"ltr\"> their<\/span><span dir=\"ltr\"> national<\/span><span dir=\"ltr\"> trade<\/span><span dir=\"ltr\"> associations,<\/span><span dir=\"ltr\"> brought<\/span><span dir=\"ltr\"> an<\/span><span dir=\"ltr\"> action<\/span><span dir=\"ltr\"> for<\/span><span dir=\"ltr\"> annulment<\/span><span dir=\"ltr\"> before<\/span><span dir=\"ltr\"> the<\/span><span dir=\"ltr\"> EU<\/span><span dir=\"ltr\">General<\/span><span dir=\"ltr\"> Court<\/span><span dir=\"ltr\"> under<\/span><span dir=\"ltr\"> Article<\/span><span dir=\"ltr\"> 263 <\/span><span dir=\"ltr\">TFEU<\/span><span dir=\"ltr\"> against<\/span><span dir=\"ltr\"> the<\/span><span dir=\"ltr\"> new<\/span><span dir=\"ltr\"> marking<\/span><span dir=\"ltr\"> specif<\/span><span dir=\"ltr\">ications<\/span><span dir=\"ltr\"> for<\/span><span dir=\"ltr\"> single<\/span><span dir=\"ltr\">-use<\/span><span dir=\"ltr\"> beverage<\/span><span dir=\"ltr\"> cups<\/span><span dir=\"ltr\">wholly<\/span><span dir=\"ltr\"> or<\/span><span dir=\"ltr\"> partially<\/span><span dir=\"ltr\"> made<\/span><span dir=\"ltr\"> from<\/span><span dir=\"ltr\"> plastic<\/span><span dir=\"ltr\"> as<\/span><span dir=\"ltr\"> defined<\/span><span dir=\"ltr\"> in the<\/span><span dir=\"ltr\"> Commission<\/span><span dir=\"ltr\"> Implementing<\/span><span dir=\"ltr\"> Regulation<\/span><span dir=\"ltr\"> 2020\/2151<\/span><span dir=\"ltr\"> (\u201cIR<\/span><span dir=\"ltr\">2020\/2151\u201d)<\/span><span dir=\"ltr\"> of 17 December<\/span><span dir=\"ltr\"> 2020.<\/span><\/p>\n<p><span dir=\"ltr\">The<\/span><span dir=\"ltr\"> principle<\/span><span dir=\"ltr\"> of this<\/span><span dir=\"ltr\"> marking<\/span><span dir=\"ltr\"> requirement<\/span><span dir=\"ltr\"> is derived<\/span><span dir=\"ltr\"> from<\/span><span dir=\"ltr\"> Article<\/span><span dir=\"ltr\"> 7 of the <\/span><span dir=\"ltr\">Sing<\/span><span dir=\"ltr\">le-Use<\/span><span dir=\"ltr\"> Plastic<\/span><span dir=\"ltr\"> Directive<\/span><span dir=\"ltr\"> (EU)<\/span><span dir=\"ltr\"> 2019\/904<\/span><span dir=\"ltr\"> (\u201cSUPD\u201d). <\/span><span dir=\"ltr\">The co<\/span><span dir=\"ltr\">-applicants, PACCOR, Flo, Dopla, ILIP, Aristea, Dart, and Intraplas<\/span><span dir=\"ltr\">, are fully committed to the objectives of <\/span><span dir=\"ltr\">the European Green Deal and the Circular Economy Policy and have in this respect adopted various <\/span><span dir=\"ltr\">sustainability initiatives. As an industry, they aim to achieve a high level of recycled materials in their beverage <\/span><span dir=\"ltr\">cups and recycling of their beverage cups after use. It follows that the beverage cups and packaging thereof are <\/span><span dir=\"ltr\">already placed on the market in the EU with symbols and markings used widely by the packaging and food <\/span><span dir=\"ltr\">contact materials industry, to allow an<\/span><span dir=\"ltr\">d encourage proper disposal, sorting and recycling thereof. <\/span><span dir=\"ltr\">The co<\/span><span dir=\"ltr\">-applicants are of the view that the marking specifications for beverage cups now established by the <\/span><span dir=\"ltr\">Commission in the IR 2020\/2151 are unnecessary and unsuitable to achieve the aim of the SUPD, which is to <\/span><span dir=\"ltr\">prevent and reduce the impact of beverage cups on the environment, in particular the aquatic environment, due <\/span><span dir=\"ltr\">to littering by consumers, as well as to promote the transition to a circular economy.<\/span><\/p>\n<p><span dir=\"ltr\">In fact, despite the Com<\/span><span dir=\"ltr\">mission\u2019s analysis that plastic items represent a significant volume of the marine <\/span><span dir=\"ltr\">littering, beverage cups have been found to be only 35th on the list of items most widely found on beaches. In <\/span><span dir=\"ltr\">this respect the co<\/span><span dir=\"ltr\">-applicants also observe that the impact as<\/span><span dir=\"ltr\">sessment that was made by the EU legislator <\/span><span dir=\"ltr\">prior to the adoption of the SUPD, and notably Article 7 there of, does not address beverage cups. <\/span><span dir=\"ltr\">Moreover, the additional markings adopted by the Commission for beverage cups (pictograms and information <\/span><span dir=\"ltr\">phrases<\/span><span dir=\"ltr\"> about the presence of plastic) are likely to mislead consumers about the correct action to perform after <\/span><span dir=\"ltr\">use of the cup. Hence, they risk being counter<\/span><span dir=\"ltr\">-productive.<\/span><\/p>\n<p><span dir=\"ltr\">The co<\/span><span dir=\"ltr\">-applicants further consider that the required written indications \u201cMade of Plastics\u201d<\/span><span dir=\"ltr\"> or \u201cPlastic in <\/span><span dir=\"ltr\">Product\u201d in the respective official languages of the Member State where a beverage cup is placed on the <\/span><span dir=\"ltr\">market, fail to take into account the free movement of products and consumers on the internal market. As a <\/span><span dir=\"ltr\">result, the product markings are likely to be in the language of the initial purchaser, and not that of the <\/span><span dir=\"ltr\">consumer who will ultimately be using the cup and be responsible for disposing it responsibly. <\/span><span dir=\"ltr\">Consequently, <\/span><span dir=\"ltr\">the new markings are likely to fail in achieving the SUPD\u2019s objectiv<\/span><span dir=\"ltr\">e of \u201cinforming consumers\u201d.\u00a0 <\/span><\/p>\n<p><span dir=\"ltr\">The markings <\/span><span dir=\"ltr\">could also easily mislead the consumer in choosing the proper way of disposing of the cups after use, especially <\/span><span dir=\"ltr\">with regard to beverage cups made from bioplastics or coated paper. This is considered potentially ver<\/span><span dir=\"ltr\">y <\/span><span dir=\"ltr\">harmful for the recycling streams in place and ultimately for the environment. The marking requirement <\/span><span dir=\"ltr\">paradoxically fails to achieve the purposes of the SUPD and those of the European Green Deal and the Circular <\/span><span dir=\"ltr\">Economy Policy. <\/span><\/p>\n<p><span dir=\"ltr\">Furthermore, the new mark<\/span><span dir=\"ltr\">ing required is disproportionate for beverage cups made entirely of <\/span><span dir=\"ltr\">plastic, since consumers are already aware that they drink from a plastic cup. The Commission failed to have <\/span><span dir=\"ltr\">recourse to the least onerous option even though it had a clear choice regarding alternative measures that <\/span><span dir=\"ltr\">could have been adopted.<\/span><\/p>\n<p><strong><span dir=\"ltr\">What is the objective?<\/span><\/strong><\/p>\n<p><span dir=\"ltr\">The aim of the action is to establish the unlawfulness of the marking requirements set forth in the IR 2020\/2151 <\/span><span dir=\"ltr\">for beverage cups, and the annulment thereof. The co<\/span><span dir=\"ltr\">-applicants see<\/span><span dir=\"ltr\">k to push the Commission to reconsider <\/span><span dir=\"ltr\">the markings now imposed for beverage cups in order to have justified and appropriate other, better, measures <\/span><span dir=\"ltr\">in place, and actions taken, to effectively encourage the recycling and recallability of beverage cups part<\/span><span dir=\"ltr\">ially <\/span><span dir=\"ltr\">and wholly made of plastic and to reduce marine littering of single use plastic products. The co<\/span><span dir=\"ltr\">-applicants <\/span><span dir=\"ltr\">consider that the Commission should promote already existing sectoral approaches that prove effective, <\/span><span dir=\"ltr\">promote the right behavioural attitude <\/span><span dir=\"ltr\">of consumers and provide a sound legal environment for and with <\/span><span dir=\"ltr\">manufacturers, traders, recyclers all along the value<\/span><span dir=\"ltr\">-chain, and work together towards the circularity of single <\/span><span dir=\"ltr\">use products that are made wholly or partially out of plastics. In this respect<\/span><span dir=\"ltr\"> the co<\/span><span dir=\"ltr\">-applicants also consider <\/span><span dir=\"ltr\">that Article 7 SUPD should be reconsidered, because beverage cups are arguably unlawfully added to the <\/span><span dir=\"ltr\">products made subject to marking obligations as defined therein.<\/span><\/p>\n<div id=\"outerContainer\">\n<div id=\"mainContainer\">\n<div id=\"viewerContainer\" tabindex=\"0\">\n<div id=\"viewer\" class=\"pdfViewer\">\n<div class=\"page\" data-page-number=\"3\" data-loaded=\"true\">\n<div class=\"textLayer\"><span dir=\"ltr\">The annulment action does not have suspensive effect,<\/span><span dir=\"ltr\"> so the marking obligations must still be applied from 3 <\/span><span dir=\"ltr\">July 2021 until the final judgment. Irrespective of the option to seek interim relief in this respect, the aim of the <\/span><span dir=\"ltr\">seven plastic packaging manufacturers is notably also to make other players in th<\/span><span dir=\"ltr\">e value chain, such as <\/span><span dir=\"ltr\">retailers, brand owners, foodservice companies, aware of the impact that the markings can have also on their <\/span><span dir=\"ltr\">operations. Once the formal announcement of the present action for annulment is published in the EU\u2019s Official <\/span><span dir=\"ltr\">Journal, inte<\/span><span dir=\"ltr\">rested third parties can apply to the EU General Court to be admitted to the proceedings as <\/span><span dir=\"ltr\">interveners.
